nuCourse Distribution Defective Units Return Policy

A defective unit is described as a unit that does not function or operate to the standards of the manufacturer. Defects are limited to, but not exclusive of bad wiring, damaged plastic, not turning on/off, etc. Defective units do not include: wrong color ordered, wrong model ordered, etc.

- Defective units to be subject to the nuCourse Distribution, Inc Return Policy. Items that are found to be defective after 90 days from the sales order, must be returned directly to the manufacturer.

- All returns must have an approved nuCourse RMA number prior to return to nuCourse. The RMA must be included in the box and the RMA number must be written on the shipping label. Returns received without an approved RMA number will not be accepted and will not be accepted and will be returned to the reseller/buyer at the expense of the reseller/buyer.

- All defective units are required to be tested by the reseller. All returns must be labeled with a description of what is defective on the unit. Items returned without a description of what is defective will not be accepted and will be returned to the reseller/buyer at the expense of the reseller/buyer.

- All returns must have all parts, accessories, cables, screen protectors, chargers, remotes, etc in order to be accepted. Items returned without all “parts” will not be accepted and will be returned to the reseller/buyer at the expense of the reseller/buyer.

- nuCourse will test all defective unit returns. If the units returned are not found to be defective, the units will not be accepted and will be returned to the reseller/buyer at the expense of the reseller/buyer.

nuCourse Non-Defective Returns

- PegPacks and nuPacks that are returned in their original packaging without any sticker price tags, sticky residue, etc. are returnable under the 45 day return timeframe from the date of the sales order. They must have an authorized RMA number. Any pegPack or nuPack returns received after the 45 day grace period, or returned in damaged condition will not be accepted and will be returned to the reseller/buyer at the expense of the reseller/buyer.

- Any products that want to be returned for any other reason are subject to inspection to ensure that they are in pristine condition and have not been opened or altered in any way. Those returns are subject to a 30% restocking fee. All shipping and return of those items are at the expense of the reseller/buyer.

nuCourse Distribution, Inc. Return Policy

Any return of the Products purchased hereunder because such Products are claimed to be defective, shall be governed by nuCourse Distribution, Inc. Product Return policies in effect on the date of the invoice, or as otherwise provided by nuCourse to Buyer in writing. nuCourse Product Return policies are located at www.nucourse.com. nuCourse reserves the right to modify or eliminate such policies at any time. Although nuCourse policies may permit Buyer to return Products claimed to be defective under certain circumstances, nuCourse makes no representations or warranties of any kind with respect to the Products. NUCOURSE HEREBY DISCLAIMS ALL REPRESENTATIONS AND WARRANTIES, EXPRESS OR IMPLIED, AS TO THE PRODUCTS, INCLUDING, BUT NOT LIMITED TO, ANY IMPLIED WARRANTY OF MERCHANTABILITY, NON-INFRINGEMENT OR FITNESS FOR A PARTICULAR PURPOSE. NUCOURSE WILL NOT BE LIABLE FOR ANY DAMAGE, LOSS, COST OR EXPENSE FOR BREACH OF WARRANTY. The right to return defective Products, as described above, shall constitute nuCourse's sole liability and Buyer's exclusive remedy in connection with any claim of any kind relating to the quality, condition or performance of any Product, whether such claim is based upon principles of contract, warranty, negligence or other tort, breach of any statutory duty, principles of indemnity or contribution, the failure of any limited or exclusive remedy to achieve its essential purpose, or otherwise. In the event nuCourse issues a return authorization to Buyer allowing Buyer to return Product to nuCourse, Buyer will deliver the Product to nuCourse's address in the United States, if so required by nuCourse, and Buyer shall bear all applicable federal, state, municipal and other government taxes (such as sales, use and similar taxes) as well as import or customs duties, license fees and similar charges, however designated or levied, on any replacement Product to be shipped by nuCourse to Buyer.
